General Terms and Conditions (GTC) for amulett-tattoo.ch

1 Scope of application

1.1 These General Terms and Conditions (GTC) apply to all services and products provided and offered by amulett-tattoo.ch, represented by Anne Faucher (hereinafter referred to as ‘Provider’). 1.2 By using the provider’s services and products, the customer accepts these GTC in full.

  1. services

2.1 The Provider offers services in the field of tattoo design and tattoo engraving. 2.2 Individual design wishes of the customer will be taken into account as far as possible. 2.3 The services are provided exclusively by prior appointment.

3 Appointments and cancellations

3.1 Appointments can be made by telephone, e-mail or via the website. 3.2 Appointment changes or cancellations must be made at least 48 hours in advance. Otherwise, the provider reserves the right to charge the deposit as a cancellation fee. 3.3 In the event of a no-show without prior cancellation, the deposit will be charged.

4 Prices and payment

4.1 The prices for services and products are available on request. 4.2 Payment shall be made in cash via TWINT or by credit card immediately after the service has been provided. 4.3 Several sessions may be necessary for larger projects.

5 Liability and warranty

5.1 The Provider shall not be liable for allergic reactions or complications arising from the tattoo, unless these are due to gross negligence or intent. 5.2 The customer will be informed about possible risks and care instructions before tattooing. Compliance with these care instructions is the responsibility of the customer. 5.3 Complaints must be made in writing within 14 days of the service being provided.

6.1 The Provider’s services are only provided to persons of legal age (18 years and older). 6.2 The Provider reserves the right to request proof of age.

7 Data protection

7.1 The collection and processing of personal data takes place exclusively within the framework of the statutory data protection regulations. 7.2 The customer’s data will not be passed on to third parties unless this is necessary for the fulfilment of the contract or the customer has expressly consented to this.

8.1 In Switzerland, including Zurich, there is also no statutory right of cancellation specifically for tattoos. Similar to Germany, tattoos are considered individually provided services that are customised to the customer’s specific wishes. Here are some relevant points to consider:

Personalised services: Tattoos are personalised services. A right of cancellation would be difficult to implement here, as the tattoo artist has already invested material and time to create an individual work of art.

Contractual agreements: It is common for clients and tattooists to enter into an agreement or contract prior to tattooing that sets out the terms of the service. This may include provisions for cancellations and refunds. It is important to read and understand this contract carefully before getting a tattoo.

Consumer protection laws: Although there is no specific cancellation policy for tattoos, general consumer protection laws may apply in certain circumstances.

It is therefore advisable to think carefully about the design and the tattooist before getting a tattoo and make sure you are completely happy with the decision. If any problems or dissatisfaction arise after the tattoo, you should first talk to the tattoo artist to find possible solutions.

9 Final provisions

9.1 Amendments or additions to these GTC must be made in writing.

9.2 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.

9.3 Swiss law shall apply. The place of jurisdiction is the registered office of the provider.
